While the breadth of practice content is impressive and the adaptive algorithm is sophisticated, the SmartScore's punitive design has been widely documented to cause anxiety in students, and the platform collects granular behavioral data on every wrong answer a child makes.

Active Class Action Lawsuit: Student Data Sold to Third-Party Brokers

Three Kansas families sued IXL Learning in federal court in May 2024 on behalf of K-12 students nationwide, alleging that IXL collects and shares student data without proper consent and sells it to third-party data brokers. The complaint alleges student data is tracked even after active use has stopped, and that IXL fails to disclose this practice to parents or obtain meaningful consent.
The Federal Trade Commission filed amicus briefs supporting the plaintiffs at both the district court level (September 2024) and the Ninth Circuit (August 2025). In April 2026, an appellate panel reversed IXL's attempt to compel arbitration, finding that school districts are not parents' agents and cannot bind parents to IXL's terms. The case has been remanded to the Northern District of California for discovery.
The case is active. IXL's policy states it does not sell student data; the lawsuit disputes whether its data-sharing practices constitute a de facto sale.
